Welcome to our online store. These Terms of Service ("Terms") govern your use of this website and the purchase of products offered through our store.

By accessing our website or placing an order, you agree to these Terms.

2. Eligibility

By placing an order, you confirm that:

you are at least 18 years old or have permission from your legal guardian;
all information provided is accurate and complete;
you are legally capable of entering into a binding agreement.

3. Products

We strive to present all products as accurately as possible.

However:

colours may vary depending on your display;
natural materials may vary slightly;
handcrafted products are unique and may differ slightly from the product photographs.

Such variations are considered normal characteristics and do not constitute defects.

4. Prices

Prices displayed on the website are shown in the selected currency.

Applicable VAT is charged in accordance with Czech and European Union tax legislation.

Shipping costs, customs duties and import taxes are calculated separately unless expressly stated otherwise.

We reserve the right to correct obvious pricing errors before accepting an order.

5. Orders

Placing an order constitutes an offer to purchase products.

A purchase contract is concluded only when we accept your order by dispatching the goods or by sending an explicit order confirmation.

We reserve the right to decline or cancel orders, including in cases of:

pricing errors;
product unavailability;
suspected fraudulent activity;
payment authorization failure;
legal restrictions.

If payment has already been received, any cancelled order will be refunded promptly using the original payment method.

6. Payment

We accept the payment methods displayed during checkout.

Orders are processed after successful payment authorization.

7. Shipping

Shipping is governed by our separate Shipping Policy.

Delivery estimates are provided for guidance only and are not guaranteed.

Risk of accidental loss or damage passes to the customer upon delivery in accordance with applicable law.

8. Customs, Duties and Import Taxes

Orders shipped outside the European Union may be subject to customs duties, VAT, import taxes or other governmental charges.

Unless otherwise stated, these charges are the responsibility of the customer.

9. Right of Withdrawal

Consumers residing in the European Union have the statutory right to withdraw from a distance purchase within 14 days in accordance with applicable European Union and Czech consumer protection legislation.
This is not applicable to personalized orders or made-to-order items once they have entered production.

Nothing in these Terms limits any mandatory consumer rights.

10. Returns and Refunds

Returns are governed by our Returns & Refund Policy.

Unless otherwise required by law, returned products should be unused and in their original condition.

Customized, personalized or made-to-order products may not be eligible for return where permitted by applicable law.

11. Intellectual Property

All content available on this website, including but not limited to:

product designs;
jewellery designs;
photographs;
graphics;
logos;
text;
artwork;
trademarks;
website design;

is the exclusive property of Stargate.Earth or its licensors and is protected by copyright, trademark and other intellectual property laws.

No material may be copied, reproduced, distributed or used without our prior written permission.

12. Acceptable Use

You agree not to:

violate applicable laws;
interfere with website security;
attempt unauthorized access;
introduce malicious software;
misuse or disrupt our services;
infringe intellectual property rights.

13. Limitation of Liability

To the maximum extent permitted by applicable law:

we are not liable for indirect, incidental or consequential damages;
we do not guarantee uninterrupted availability of the website;
our total liability shall not exceed the purchase price paid for the relevant order.

Nothing in these Terms excludes liability where exclusion is prohibited by law, including liability for fraud, intentional misconduct, gross negligence, or personal injury.

14. Force Majeure

We are not liable for delays or failures resulting from events beyond our reasonable control, including:

natural disasters;
severe weather;
war;
governmental actions;
labour disputes;
transportation disruptions;
pandemics;
internet outages;
carrier delays.

15. Privacy

Your personal information is processed in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR).

16. Amendments

We reserve the right to update these Terms from time to time.

The version published on our website at the time of your order shall govern that purchase.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain fully effective.

18. Governing Law

These Terms shall be governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Czech Civil Code, except where mandatory consumer protection laws of the customer's country provide otherwise.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

Nothing in these Terms affects any mandatory statutory rights available to consumers under applicable law.
